Legal Question in Wills and Trusts in New Hampshire

I am an only child. My father is on his death bed (mother already deceased). He has no will. Is it worth it to get a death bed will? Or should I just let the estate go to probate. ??

In other words, won't the death bed potentially complicate things?

My sorry to hear of your situation. From a legal perspective, it should make little difference if your Father has a will as long as there are no other siblings and no spouse. You would inherit. However, if your Father wishes anything to be distributed to someone other than you, a Will is necessary. Even with a Will, the estate would still go through probate. However, there are some abbreviated procedures if you are a a sole child and sole surviving heir.

The probate process can be somewhat confusing. You would likely benefit from meeting with an attorney to help you through this difficult time.
