Legal Question in Wills and Trusts in New Hampshire
Not on the deed.
My wife is on the deed to our home and undeveloped land and I am not for protection. I own my own LLC business and that is why. If she was to become ill and pass away will I get the home?

Re: Not on the deed.
In order to respond there is a need for a lot more information. Often keeping the property in the name of one spouse is less than adequate protection from liability. For example, if she gets into a major accident which is her fault, the house would be at risk. If the house were in both names, then at least one-half of the equity would be protected. Inheritance would be governed by the terms of your will or the laws of intestacy. I'd need to know the entire family structure and the size of the estate to map out the various options. You should consult with an attorney before taking any action.
