Discover Credit Card NH
My grandmother passed away on Oct. 29th, 2007. My aunt is the executor of her estate and Discover found out my grandmother had passed 2 weeks ago. We paid her statements on tiime the last 3 months and as soon as they found out she passed they send her to collections and now they keep contacting the family for payment. We don't want to continue to pay for fear of becoming personally liable. Discover said that is their policy and said no intrest will accrue any longer but they didn't give us a payment arangement and they said they can't continue to send statements to us. What should we do? My grandmother did have a house with a small mortgage and nothing else. We want to keep the house so do we wait to see if they file with probate?

Sadly, when you die you still owe discover card...that is if the estate has assets to pay it. Send Discover a copy of the death certificate and tell them not to call you anymore. If the estate is being probated, Discover will be paid if there are sufficient assets.

You did not indicate if your granmother left a will or if probate proceedings have been commmenced. There are a few possibilities to deal with this type of debt. I would suggest that you should hire an attorney familiar with the probate process to help guide you through the court system.
