My father passed away without a will. There are 5 heirs. The only property he has is a house with a morgage on it and two cars and some small items nothing with value. I reside in the house and have lived with him for 10 years with my 3 children. I want to keep the house and buy out my siblings how do I do that. 3 do not have a problem. 1 wants to keep it as rental property even though he lives out west and had not kept contact w/family. What are my legal rights?? I cooked and cleaned for him I took him to appointments I cared for him.

Part of the answer lies in how the property was titled. Did your father own it himself?

An estate is divided up by value, not things. The house must be sold and you can buy it for fair market value.

There is a lot more to this question but basically you have a good chance of getting the house if you can afford to buy it.
