Legal Question in Wills and Trusts in New Hampshire

My father died without a will, and he has credit card debts. The only assest he had was our house. My name is not on the deed, but I have lived in the house my whole life. I am also disabled. Can the probate court force me to sell my home?

The strict answer to your question is, yes, the court can force a sale. However, that is not the desired result and often an arrangement can be made with creditors to defer or delay a sale while other arrangements are made to settle the credit card debt. There are some potential ways to address this type of problem and it would likely be best for you to meet with a probate attorney to review all the facts and determine if there is a viable alternative to the sale of the real estate.
