Legal Question in Wills and Trusts in New Hampshire

Probate Laws

My two sons are named in the will of their biological father as recepients of a parcel of property that he was renting with option to buy. He still owed $3400 on the land. We also have been told he has $20,000 in credit card debt. His brother has elected not to file the will with the courts and has worked out a deal with the owner of the land to buy it back. We are concerned that not filing the will is illegal and are concerned that the land buyback is illegal. My sons are concerned that his creditors could come after them if they accept the money. His brother told us the money would be tax free. It sounds fishy! Their father was a resident of New Hampshire and my sons line in Texas and Arizona.
