Probate a will when there are no assets?

I am POA and full beneficaiary of my mother's MA will. She is now a resident of a nursing home in NH and on Medicaid. She has less than $100 in assets. What do I do with her MA will? (She is terminally ill) Do I need a NH will? There is one living brother.

It is likely you will have to do nothing upon your Mother's death. There are no assets to probate. If she does have assets over which probate would apply, the Massachusetts will, if vaild there, would be submitted to the New Hampshire Court.

I do suggest that you have a set of Health Care Directives prepared to deal with her medical situation. As always, it is often best to consult with an attorney to provide all of the facts so that a more comprehensive answer can be provided.
