Legal Question in Wills and Trusts in New Hampshire
sibling liability of debts after death
The only close relative I have left is my brother. I have a house with a mortgage over the value of the house, plus some other debts. If I died, would my brother be responsible for any of it? I do have some life insurance from work, but it wouldn't cover all of it.

Re: sibling liability of debts after death
In the event of your death, your brother would not be personally responsible for paying the mortgage. However, the bank would likely take the house, sell it, and apply the proceeds toward the debt. As to the life insurance, be sure to name your brother as the beneficiary. It will pass to him outside probate proceedings. I do suggest that you should meet with an attorney who can help you will a will, health care directives and power of attorney documents in addition to any other needed tools.
