Who protects the individual?

Who protects the individual when injured on the job, for doing their job that is denied WC? When there is a continueing injury/disability?

Workers Compensation in NH

If you have been injured while working, then you have certain rights in NH. You can have the medical treatment that you require paid for by the workers compensation insurance carrier. This is the insurance company that your employer pays to handle these claims. If you miss several days of work then you can receive compensation. This is 60% of your average weekly wage. So for every $100/week that you may earn you get %60. If you have a permanent disability, then yu may receive an amount of money that is determined by law and depends on the type of disability and the extent of your disability.

The NH Department of Labor is the State Agency that oversees this system. They do not represent you and they do not represent the employer. They are like the judge in a court case. If there is a dispute then they will decide what the answer is. There are several levels of appeal.

If you have been denied, then you need to appeal that decision to the Workers' Comp Department of Labor. They will give you a hearing and you may still receive back wages if you are out of work, and then you may continue to receive compensation as long as you have a disability.
