Legal Question in Personal Injury in New Jersey
damages-auto death case
Is fear of impending death compensable in N.J.? If a person dies or loses consciousness almost immediately after the impact, is the physical pain upon initial impact (e.g. multiple fractured ribs) compensable?

If there were some period of pain and suffering it would be compensable, but the most substantial part of a wrong death civil claim is the loss of the earnings and services of the deceased, which for a young person would be very substantial.

You are handling a case (as executor of the dead person maybe?) and you are asking a computer bulletin board about this? Why?
You need a lawyer who handles death cases. A good lawyer. A lawyer who can answer this question and the many other issues that will arise in the lawsuit.
Step One: If you don't have a good lawyer, call me and I will recommend a couple (I do not do this work any longer).
Step Two: If you have a lawyer and the lawyer can not answer this question, fire the lawyer. Then see step one.
This is serious stuff. The insurance companies will do everything possible to cut down the payment they make.

There's a lot of details I would have to know to provide you with a real answer to this question. Pain and suffering like the kind you are describing can be compensable under many circumstances and often times forms the bulk of a personal injury recovery.
