Legal Question in Landlord & Tenant Law in New Jersey
Dear Law Guru
My family & i have lived in a rental property for one year and 3 weeks. In our home there are two workers. In December one was layed off & recieved minimal un-employment. As bills & other expenses rose we put rent on the backburner. The unemployed became employed in February. We have just caught up to our other expenses. The Land Lord now wishes to evict us from the property. He claims that we owe $12,400.17 in rent, late fees, & utilities. We have had several verbal agreements on when rent could be paid. Now, months later, he wishes to remove us from the property. We have been on time with alll of the rent in May, June, & July. My question is this. Could he evict us & how soon? We read the pre amble & the document sent by the state & it says that it could be more than a year. In which time we would be able to pay. If we pay him before a trial does he still have a case? What are our options?

Generally if a landlord is suing to evict you because you only because are past due on rent, he must accept payment up until the date of the trial. However, if he is suing to evict you based on another reason, it may different.

Rent default suits are normally decided very quickly, usually in a matter of weeks. If you have all the rent plus any amounts such as attorney fees that are claimed as "additional rent" under the lease, the court will let you stay.
