If an executor has knowledge a theft has been committed, does he have a fiduciary obligation to report it and can he be held liable if he does not?

Response by Attorney Michael Kotik. In order to answer your question I would need more information as to what actually had happened. There are several things that need to occur, in terms of the executor's fiduciary duty. However, it would be difficult to answer your question without knowing more of the facts behind what happened.
