Laid Off
After 9 yrs my husband was laid off, but they kept an employee with less time in and younger because he knew a new piece of equipment. Two weeks ago Mgt.. said they wanted them to cross train on each other jobs but every time he wanted to work with the other employee management pulled the other employee away to do something else not allowing him the opportunity to learn the new equipment. There were emails which someone else in the company found and gave to my husband showing that he was being let go, they started10 days ago. Mgt. was going back and forth trying to get the lowest amount of severance etc possible because they felt they ''floated'' him for a while since their largest client switched to the new piece of equipment. My husband didn't sit there with his hands folded, he still had other work to do. Everyone has access to these email but Mgt. doesn't realize this. He was caused extreme embarrassment because others knew what was going on, plus he feels after 9 years he is being discriminated against due to age and health. He suffered a heart attack 4 years ago but since returning to work after a 4 month recovery he has taken only his time accumulated each year. Do you think he should pursue this leagally?

Based on what you have written, your husband may have legally viable claims under various New Jersey and Federal laws. He should consult an experienced attorney who will review his situation and discuss the options available. While the attorney will charge a fee for the consultation, it will be money well spent as your husband can then make an informed decision regarding how he wants to proceed.
