contract for buying a business from a family member?

Yes, you need a contract because the business itself may have liabilities that you ought to protect yourself from irrespective that the seller is a family member. The good news is that the legal costs are not going to be high because you and the family member probably already agree on many things, so no need to waste time and money on negotiations.
