Legal Question in Administrative Law in New Jersey
Tipsy bought 50 cases of wine from Simsonsberg Wineries at R500 a case. Both parties agreed that the wine would be sent by rail to Tipsy�s residential address the following week. The night after the conclusion of the contract the cellar in which the wine was stored burnt down after having been struck by lightning. Most of the wine was also destroyed. Upon investigation of the matter the manager of the winery admitted that he had not yet separated the wine bought by Tipsy from the stock. is Tipsy liable for the purchase price? what will happen if the wine was destroyed in a fire started by the manger in order to submit fraudulent insurance claims?
