Legal Question in Banking Law in New Jersey
Bad check Statue
I recieved a letter form a lawyer stating I wrote a bad check back in 1993. Isn't there a statue of limitations on sold goods that limit this to 4 years? The amount was for $143, Should I respond to this.

Re: Bad check Statue
Based on my experience, the letter is probably from JBC Legal. These guys are notorious for trying to collect on stale, past the statute of limitations checks. If the check is from 1993, then it should be beyond the SOL to sue on but not beyond the SOL to attempt to collect on. The letters that I have seen threaten to file suit, even though they cannot. This is a violation of the Fair Debt Collection Practices Act.
