Legal Question in Banking Law in New Jersey
payroll check cleared-do I have to pay back?
Sir, I recently deposited and
cleared 2 checks issued by a former
employer about 18 months back
from PA. They probably put those 2
checks on hold which expired. Now
its lawyer called me asking me to
return the money -$7500,
otherwise they threaten me that
the banks lawyers are going to
come after me if they report. I told
them Ill look into the matter but
since I recently lost my job and the
fact they call me repeatedly
threatening me, make me think I
can keep the money. Pls advice.

Re: payroll check cleared-do I have to pay back?
It's very unlikely that the bank's lawyers or the bank are remotely interested unless the check was counterfeit or if it wasn't made out to you. It sounds like an issue between you and the former employer. The key question is why they think that you are not entitled to the money?
