Bankruptcy Questions

My son was in a car accident with my car which were he was found to be at fault. A few days after the accident, the insurance company said that our check bounced and the other driver's claims could not be processed. We are now being sued for an amount of money that we will not be able to pay out of pocket. After consulting a lawyer, he suggested that we file bankruptcy so that we will not have to pay out the claim. I am not sure this is the best course of action but our alternatives are limited. Any suggestions?

Let me get this straight. You went to an attorney, told him/her your entire story, he/she analyzed it and came to a conclusion that bankruptcy would be in your best interest. You were not sure that his/her advice was good. So you decided to go on the internet, give a very brief version of the story you gave to the attorney, and now you expect better advice than the attorney you went to. Is this what happened? I think so. What I am trying to say is that you should rely on the advice given by your trusted attorney. If you do not trust the attorney's advice, get another opinion from another attorney who is given the same information as the first attorney (or even more information if you have it). Bottom line - The advice given by any lawyer on the internet is based purely on the little bit of information that is given in a very brief format. There may be other factors that would change that opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have discussed this with an attorney, either take that attorney's advice or contact another attorney to discuss your matter in more detail. Cannot determine whether bankruptcy makes sense based on the little information you have provided. You really need to meet with and retain a bankruptcy attorney who can review your situation in depth and then render advice and counsel to you as to whether bankruptcy is an appropriate option to consider.
