Legal Question in Bankruptcy in New Jersey

help

i just defaulted on my chapter 13 due to reduction in salary. Can I file chapter 7? Just received notice that my mortgage is in default. I want to sell rather than lose. Bought house for 120K, now worth 290K. What are my options?

As a last option can my fiancee file for bankruptcy to stop foreclosure until we can find a buyer? His name is also on the mortgage & deed.
