Filing a case against my employer

Hi,

I am an Indian working as a consultant USA. I am an employee of an INDIAN company which is established in NJ, USA. I am working in a Client location in CA, USA. My employer gets money from my client company everymonth and I receive as Salary from my employer. From past 3months I am not receiving any money/salary from my employer. I gave so many emails did phone calls but there was no response. I have coulple of friend who are in NJ, USA and I told to go to my company. After going there they found the truth that my employer has taken all the money of his employees and closed the company with out any notice. He took all our money and there is no response from him. Is there any possibility that we can file a case against him, if so could you please tell me the details for how to proceed on this. Now I dont even have the proper status in USA as I dint receive my paychecks since March-2007 to till date. And there is no chance of getting W2 for this year. What can we do like these people? I want to sue this person as I have gone lot of stress and strain and lost lot of money.

Could you please suggest me in proper direction, I would really appreciate your help on this. Thank you.

you might have a criminal charge against the man who stole your money, for fraud. call the county prosecutor for the county in which your employer's company was located.

also, my friend the immigration attorney says that he could definitely help you out with immigration problems. also, the United States federal government would probably get involved in your situation (that is probably a good thing, they may go after him pretty forcefully).
