Legal Question in Bankruptcy in New Jersey

How can you find out if someone filed for bankruptcy

A person owes someone money. They did not repay the debt, He said he had to file for bankruptcy, how can anyone be sure that he filed or if he's lying? Can we find out through the county court records, or some place else?

Re: How can you find out if someone filed for bankruptcy

if the person lives in northern n.j., you may contact the bankruptcy court in Newark. you may call 411 to get the number. You may need full name, address, and, perhaps, social security number. IF s/he did file bankruptcy you, as a creditor, must receive notice of it from the court so that you may have an opportunity to challenge the discharge of the debt.

Re: How can you find out if someone filed for bankruptcy

If a person files bankruptcy they must file at the bankruptcy court covering the area where THEY live. Call 411 to get the number for the bankruptcy clerk's office in the area where that person who owes you money lives. If you have not received a notice of the filing and you are a legitimate creditor - most likely the person did not file bankruptcy or if they did they didn't list you as a creditor- otherwise you would have received notice from the court. In either case you may collect on your debt. Call my office at 877-832-2376 if you need further assistance.

Call VCIS at 877-230-2547, and follow the prompts. You can also check through the PACER service on the internet (go to the New Jersey bankruptcy court website on the internet). A bankruptcy filing is a public record and will also eventually appear on an upper court judgment search for the person in question.
