Legal Question in Bankruptcy in New Jersey
inheritance
My mother in law passed away last Feb. without a will a local lawyer is the administrator and there is $ going to be split between 4 children. My sister in law & her husband have claimed bankruptcy 2 times in the past 9 years the first one was with forecloser of a home and credit card bills the second credit card debts. They are about to get approx. $28,000, can they in anyway lose this $ to their past debitors?

Re: inheritance
there is no easy way to answer your question, without a lot more information. Just for example, how much of the debt was incurred after the bankruptcy filing? did they get a 'discharge' in bankruptcy both times?
They need to contact an attorney who handles bankruptcy and related matters. They should be prepared to bring in all of the papers from the bankruptcies, and from the debts they have now and have had in the past. They need some solid legal advice.
If you would like, give me a call. My contact information can be obtained from the links below, just click on the Attorney Profile link. Let my secretary know you found me through LawGuru, and I will give you a free initial consultation.
