Legal Question in Business Law in New Jersey
Breach of Contract / Theft by deception
I have a contract with my previous employer stating that they have to pay me commission on the accounts that I brought in while employed there. It has come to my attention that there are a dozen or so accounts that I have not been paid for and I have been told by them that these accounts are canceled. The truth of the matter is that they are not canceled. Can I suit them for Breach of contract and or theft?

Re: Breach of Contract / Theft by deception
You may have an action for both breach of contract and several torts.
Courts and juries do not look favorably on bigger companies depriving individuals of what they earned.
Of course, your case will depend on the documents, your other proofs and the damages. We have handled similar cases in the past if you care to call us.
Re: Breach of Contract / Theft by deception
If the facts are as you state you likely have a cause of action against your former employer.
Documents need to be reviewed to be certain.
If we can help, please contact us.

I would agree with the previous attorney's posting. Of course, you'll want to balance the amount that you're owed against the costs of litigation to make your decision.
Re: Breach of Contract / Theft by deception
It depends entirely upon your contract, which I have not reviewed, but you may have a claim for breach of contract, and another under the wage payment and collection law. We handle these cases. Give us a call at the contact information below, and we can talk about your options.

Re: Breach of Contract / Theft by deception
You now have responses from four attorneys. Based on what you wrote, you have a valid claim. It will depend on what the documents say, however.
You will probably have to sue them to make them pay. They are already lying to you, and that is a really clear indication of what they intend to do: pay you nothing.
If you would like, give me a call; I am in Hackensack (northern New Jersey). I will be happy to discuss
this with you; a brief telephone consultation will be free.

Have you thought about going to the police? Might be a cheap alternative.
