Legal Question in Business Law in New Jersey

Business of reselling

I've never done anything business-

like in my life, but my mother has an

idea for a business, and I was

wondering where I could get some

information about any legal

information I would need. I would

like to know if (1) this concept is

legally workable, and (2) what

processes we would have to go

through to make it work.

She plans to buy a food product in

bulk and resell it in different

packaging as a health/beauty

product. We weren't sure about

venues, but we were thinking about

health food stores or possibly an

online business. Also, we wanted to

donate a percentage (perhaps 100%)

of the profits to a particular cause,

and she herself would be overseeing

how the funds would be distributed

(providing healthcare and schooling,

etc. in certain areas abroad). We live

in New Jersey, if that makes a

difference.

If anyone could get us started on

some answers or resources, it would

be greatly appreciated.

Nearly everything that can be sold as a health or beauty product is regulated in some way by the FDA even if that is only to formally place it into a category of unregulated products. Additionally, dealing in health and beauty products frequently makes product liablity insurance a must even if you are dealing through a corporation or LLC. So, before you concern yourselves too much with the mechanics of starting a business, you should explore those issues first.

You should immediately consult with a tax and business lawyer! Most likely, you should start a LLC. Both you and your Mom would be members.

An investigation of the product and any needed government approvals is also required.
