That is not possible to answer with the information given. An agreement to do something unlawful is not enforceable in a court. So, if the agreement requires the employee to participate in something unlawful, it is unenforceable to that extent. However, the fact that an employee believes that a company is doing something unlawful does not excuse performance of a valid contract. Conversely, the employee cannot evade the law by citing a contract that requires him or her to do something unlawful.
