Legal Question in Business Law in New Jersey

Contract for cleaning service

I contracted a cleaing service to clean my business. Their contract normally is for 24 months, but because I was hesitant to commit to 24 months, they changed the contract to say ''Six Month Trial''. The 6 month trial is over and I have been receiving and paying for their service for about 18 months total now, or 12 months passed the original 6 month trial. Am I now still responsible to continue with their service until the full 24 months of the contract is up, because I never cancelled after the 6 months? By continuing with their service I implied acceptance for their contract or is the contract completed after the 6 months? Their contract says, This service agreement is to be in effect for 24 months from the install date and 30 days written notice is required prior to end of 24 months to be sent to them by cert. mail or the agreement renews itself. The agreement was changed to say Six Month Trial, so is the 24 agreement valid? Or can I cancel this agreement? Thanks.

Re: Contract for cleaning service

It really depends on what the intention of the parties was. On its face, it would seem that after the six month trial elapsed, and you continued to pay for and receive cleaning services, you implicitly agreed to the balance of the 24 month period unless you and the cleaning service discussed something differently.

I disagree with the other attorney. It is not clear whether you must continue or not. It will depend on several things, including the exact language of the contract.
