Legal Question in Business Law in New Jersey

contracts

f was 20 when he represented himself to an auto co. as being 21 yrs of age. he purchased a car for $1550.00. he traded in another car and financed the remainding balance. he received the car. he lent the car to d who lent the car to someone else. ever since d lent the car out it has never been recovered. f stopped making payments on his car, so the auto co brought suit against him. f claims that the contract should be disaffirmed without having to pay auto co. because he was a minor at the time the contract was made? can f do this and why can he?

Re: contracts

This sounds like a law school question, which is inappropriate for this website. However, being over 18, f is not a minor unless the local laws consider a minor to be under 21. If a minor he can disavow the contract, but may be held for fraud for the intentional misrepresentation of his age. Plus, he had performed by making payments, so he might still be liable for any balance due. Why hasn't he reported the car stolen and processed a claim under his insurance
