Legal Question in Business Law in New Jersey

Copyright laws in regards to logos

I plan on offering a service were I can create team logos for fantasy sports. If I were to create a logo using parts of two logos from existing major sports teams to make a new logo, am I breaking any copyright laws?

Re: Copyright laws in regards to logos

That issue is very complex but, the way you phrase it, it is very likely that you would be violating copyrights and perhaps trademarks also. Even if a court were to find that you were not violating these rights, the basic question is: how much money do you have to fight? Both the teams and the NFL will certainly sue to prevent you from using anything that is recognizably similar to a team logo. They are very vigilant and they come with very high-powered help. Some years ago, I had the experience of defending a small business against some of the biggies in the cartoon and comic publishing industries. Both my client and I were very pleased when I was able to keep the damage award under $200k. Judge accordingly.

If you are using a portion of established logos you probably need approval from the licensing arms of the governing bodies (major leagure baseball, basketball and football, etc.). Best is to check with a patent and trademark attorney.
