Legal Question in Business Law in New Jersey

defendant #1 made a verbal and oral agreement to refund me money for a faulty job he did at my wedding. he did not come through on the arrangement. defendant #2, his paramour made a verbal and written agreement to take up defendant's #2 responsibility. i only received partial payment, and both parties are avoiding my calls. d#1 does not have a legal job, but d#2 does. So can I sue both?

Your best approach is to sue both. That way, whatever they have to say about any claims between them will not affect your recovery.

You should sue them both, right away. Delay does not help you.
