We are a LLC and hired a worker for 1 year. He failed to report for work and still hasn't reported.
He has not submitted a time record since 2/2/07 but was paid upto 16th. On 3/1/07 he sent over all time sheets with many missing. After investagating this situation we can match gas receipts to his home when he reported he was working 60 miles away.
How can we collect the misrepresented time and overpayment to his salary.

I'm not sure why you were paying him at all if he never reported for work. Nevertheless, it sounds as if (1) you paid for something that you did not receive and (2) he presented false records to get paid. If the amount is large enough to warrant it, you can sue in either Small Claims Court or in Special Civil Part. If you need help, call or email.
