Legal Question in Business Law in New Jersey
fired for having an eggnog toast on christmas
i was recently fired under my company's policy which states that consumption of alcohol on the premises could result in actions up to and including termination. i had just become the general manager of a store this year. in the three prior years i had worked for this company, all the general managers i had worked under had had eggnog toasts on christmas to congratulate the staff on a good season. however, i was reported for doing so this year and along with my sales manager was fired after a one week suspension. the other two managers in my store that also led this toast, however, only received warnings. i was wondering if i have any grounds to bring an unjust firing suit against my former company. i would appreciate any advice you may have. thank you.

Is there a written formal policy on this? Check the company manual. Since there was disparate treatment and the situation is common in the company (eggnog toasts), this sould like a possible discrimination or improper firing case. You should consult a labor attorney.

From what little facts you gave its sounds harsh and without precedent. Check your written company policies. This may require some investigation as to what has occurred in the past and why your situtation resulted in the firing.
