Re: Forgery

Big problems. Contact a lawyer immediately, someone near you who handles lawsuits, and not just car accidents, someone who handles commercial lawsuits. You can not handle this on your own. You may need advice on how to deal with the companies who will claim that you personally owe money to them, based on the forged applications. That would be in addition to going after your worthless partner, and in addition to figuring out how best to salvage whatever you can from the business.

I am not near you, but if you would like, give me a call; I am in northern New Jersey. I will be happy to discuss this with you; the telephone consultation will be free.

Re: Forgery

Yes, depending on the specific facts, there are several forgery offenses that might have been committed. That is not your biggest problem nor should it be your first concern.

You need to take immediate action to ensure that you do not have personal liability for any fraudulent act by your partner. Act now. Anyone who deals with the business as an entity may be entitled to recover their loss against you personally even if your partner is at fault. You can cut that off, but you have to to it promptly. When the dust is settling on that, you can worry about getting your pound of flesh from your partner for the insult.

I recommend that you engage a lawyer to help you. Few people are familiar with the requirements of shutting down a business and it is not something that you can afford to learn by experience. I do business law and am close to you. If you need assistance, call or email using the information in the Attorney Profile linked to this reply.
