Legal Question in Business Law in New Jersey

Gym membership

I had a year contract w/ gym the last month/pymt was Oct 08. In Sept 08 I called asking what I need to do to cancel membership at end of year because I haven't used facility for most of year. Sales person told me I should give it the month and if I still want to quit then come in and fill out paperwork to resign.

In October I went to gym to cancel salesman told me I can quit but I have to sign paper saying I'll pay the extra month since they charge one month after you resign. I asked him why didn't he tell me this when I called a month earlier he had no answer.

I ended up disputing the credit card charge so credit card gave me a credit. Recently I got a notification that a certified letter from lawyers office needs to be received by me. I haven't picked it up from post office and it's going to be returned to sender.

What will happen if I don't get the certified letter from lawyer? Do I have a case to not pay the gym?

Not my area of the law, but did you consider reporting them to the BBB and your County Dept of Consumer Affairs? Might be your best way to go in the long run.
