Legal Question in Business Law in New Jersey
Hi,
My name is Monali Geria and I am the CEO of my firm named Univision Group, Inc. We are a Staffing and Recruitment company established and liscenced in the State of NJ. We recently received a legal notice for the use of name Univision Group, Inc from the Univision Entertainment / Television company for the use of same name. What should we do? Do they have any rights to take legal action againsht us. We have been establised since 2006.

I suspect that Univision Group is alleging trademark infringement and what you received was a letter from their attorney demanding that you cease using the name "Univision Group". These types of claims involve both federal and state law and you probably should retain an attorney to deal with the other side. I currently have a client who was faced with the same type of demand. You should never post so much personal information about a legal problem on a public web site. You may have a significant issue from a practical standpoint. Even if Univision TV does not have a valid claim, the cost to fight them would be astronomical!

I agree with the other authors and you should consult a good trademark attorney. There might be a claim against you, even if NJ approved your using the name. Its approval just means that no one has registered a similar name in NJ. This does not mean you have blanket approval to use the name. There are State, Federal and common law statutes and cases involved. It is also possible that if the businesses are not similar you may be able to use the name, but for limited purposes. Expect to pay up to several thousand dollars to both check the legitimacy of the registered names and limited purposes, plus, possibly, getting national approval for use in your limited area.
