Legal Question in Business Law in New Jersey

Home Shop Zoning Laws

Hello & thank you.

I have started an upscale Consignment business, working out of my home, and also have a website, www.oliviasshabbychicporch.com. I have been using yardsales & online orders as a main source of sales, but want to open--name removed--s ShabbyChic Porch to the public. I am a registered business owner in NJ, 202437569.

I reside in a development, near a main highway, & have a high traffic area passing my home, which would result in a continual amount of shoppers stopping at my home to shop, however, would zoning laws prevent me from doing this?

Also is there a limit to the amount of Yardsales a resident has? Can I advertise a Yardsale open ''everyday'' or every week?

Thank you very much. Have a good day.

Re: Home Shop Zoning Laws

To give a precise answer to your question, a review of your municipal zoning code is necessary. I would expect to find that your business is in violation of the code if you conduct any substantial commercial activity on the site.

Home businesses are tolerated by most towns even if they don't strictly fit within the letter of the code. However, if parking or traffic becomes a problem for your neighbors or for passers by, there is sure to be some form of action by the code officials. I am surprised that you have not drawn any adverse reaction with your regular sidewalk sales.
