Legal Question in Business Law in New Jersey

Do I need liability insurance for my business?

My business is a staffing company, set up as a single member LLC. I send out bartenders, wait staff, BBQ grillers, etc. to private and corporate events all over NJ, parts of NY and PA. Many events are in private residences. The people that I send are not employed by me, as they are not on my payroll. They get paid by the client, as do I. If they cause property damage or bodily injury at a client site, am I liable since I am not their employer? Do I need any contracts between me and the client or between me and the people I send them?

You should have a master service agreement as between you and your clients as well as the contractors you send out. Here, assuming you are paying these contractors, you need to be careful that they are not misclassified employees.

Have a comprehensive general business liability policy would be a very wise choice and probably not very expensive. If there is some incident of gross negligence you will get sued even if you have a good defense so a policy that will cover for legal fees, for example, will go a long way.

I suggest that you consult with a lawyer in private and discuss your objectives in more detail. You can start by calling around to several for a free phone consultation, get some insights then pick the best fit to work with.

If you would like to discuss further over a free phone consult, feel free to contact me anytime that is convenient.

Our firm is now referred by the American Bar Association (see under the New York section): http://www.americanbar.org/groups/delivery_legal_services/resources/programs_to_help_those_with_moderate_income.html
