Legal Question in Business Law in New Jersey
Manager Bonus payout
The final year Manager bonus for my company pays out at the end of the fiscal year. The bonus is based on business written and installed (the equipment must be installed before end of the fiscal year). Our Fiscal year ended November. I wrote a number that would pay out $25,00 dollars. I could not get the equipment installed because the company had major product shortages and ran too few trucks. Do I have a case to go after this money?

Re: Manager Bonus payout
If the payout is a real bonus, it is discretionary with the employer. However, if it has the characteristics of a commission in the sense that it is consistently paid on a formula basis, then a court might rule that it is a commission and has been earned.
