Legal Question in Business Law in New Jersey

Merchant account order stopped

I signed up for a merchant account for my new

business via email, phone and fax. I did not receive the

credit card equipment when promised; the sales

person gave me a new eta twice. When I did not receive

the equipment the second time it was promised , I

called to cancel the whole thing. The sales person sent

the equipment ovenight the day after I called to cancel

and I refused delivery. I do not wish to enter into a three

year contract with a company who's word I cannot trust.

Am I bound to the contract that I signed even though I

refused the equipment and have never used the

account? Thank you.

Re: Merchant account order stopped

Your obligations depend on the nature of your relationship. Have you signed any agreement with the company? What did you sign when you sent in your application? In any event, it is unlikely that you are bound to a 3 year contract. At worst, you may be subject to a cancellation fee.
