Legal Question in Business Law in New Jersey
Naming a Business
I am in the process of starting my own intimate apparel website. The name I chose is already being used by a clothing company who DOESN'T sell intimate apparel(they are located in another state. The name is an exotic name of a flower so I don't think it's trademarked. Would you know if there is a possibility of me running into any legal problems in the future if I used this name?

Re: Naming a Business
You need to conduct a full trademark search prior to using a proposed name. If not, you could be liable for significant damages for trademark infringement. It's best to spend some money now to avoid these damages and the cost of rebranding later.
