non payment

I have been working with a staffing firm for the past 2 years. the arrangement defined by the agreement was that i would get third of fee paid by the client. I made about 10 placements and collected 9 of them. Two months ago i told the business owner that i am going to start my own practice i did not want to continue. He asked me to stay and continue until end of the year. TOday he called me and said that i did not do much work lately and he would not pay me for the pending 1 placement (10K) plus for 2 other candidates who are going through interviews and may be placed in near future (about 20K).

Our contract was straight forward that defines the terms (35%) of the fees collected and a non-compete.

I can not find the contract but he must have it. Can i sue the business without the contract and do i have a case in claiming the pending placements.

If you were the cause of the placements then you are entitled to be paid unless the contract has conditions in it to the contrary.

The missing contract will present problems but not anything that is insurmountable.

The amount involved would seem to require as suit. You can't walk away from $30k in commissions.
