Legal Question in Business Law in New Jersey

Hi,

(Non Perfect English Writer)

In 2011 I registered my company as a food distributor and went to a previous employer to present it and become partners, me selling his products to my customers in exchange of a sales %, and they agreed.

We never wrote any agreements and they promise me to help me build the company. In the meantime, we were using their trucks, their products and employees to deliver the products, while I was out selling and building a name with my work and service

Without consulting me, they opened a bank account, using the Employer Identification Number that I registered. Because of poor communication and changes in their ways of due the things, I just decided to end up the relationship.

I want to know what can I do in order to protect my business. The invoices have the name of my company but their address.

Can the go to the stores to collect the account receivables?

Can I sue them for using my name and open a bank account with my EIN?

They can not use your EIN, unless you agree to it.
