Legal Question in Business Law in New Jersey

Non-Complete Clause

My friend works in a hair salon where 99% of the business is by refferal by satisfied customes utliziing the stylist with said trade, she recently landed another job in a different town and the previous boss threating suit pulling out a non compete clause in which no witness was there. Does the ''boss's clause'' hold water?

Re: Non-Complete Clause

I can not definitely answer your question without looking at the document that you are talking about, and finding out a lot more.

your friend certainly has the right to work and earn a living, and the boss can not 'run her out of town'. A judge will be reluctant to put your friend out of work. that is not the whole answer to your question, though.

you do not need a witness for a contract to be binding.

what this document says, and how it is said, will be important. your friend may want to consult an attorney near her, and get some advice.
