Legal Question in Business Law in New Jersey

Not Being Paid on time, like 2.5 weeks late! Continually

I am a contractor for Hooper Holmes which as a paramed. I resigned from the office in Dayton, Oh, which is ran by employees of Hooper Holmes. I have bee there for 2 years. Almost every check issued is late, not always extemely late, but in some instances, 3 weeks. Right now my check from the last 2 weeks of Jan 2001 has not been received. This has caused many financial problems, at times I dont know to pay my bills first, to get out of late fees and not worry about my credit, Or to wait it out and never have good credit again. The choices have been, pay your bills on time, run the possibility of bank charges for covering the checks, or not pay the bills in a timely manner and get charged late fees. Keep in mind I only made 5,000 through this contracting agreement last year, so every dollar counts. Their regular employees are paid on the 1st and 15th without fail. We turn out time and services rendered in on the 1st and 15th. I realize that it may take a week to get a paycheck in return, but not 2-3 weeks. I have been to a Dr to get medication for nerves and have bee suicidal over this. Can I sue for pain and suffering?

Unless you can show that they intentionally paid you late to drive you crazy, there is no cause of action.

You may want to turn them into the Federal Wage and Hour people in order to speed up getting your check.

Good Luck!!!!
