Penelope Hayes bought a house in Morris County, New Jersey, located directly across the street from a dirt pit. A few years later she finds out that Morris County has a couple of potential uses for the pit. One of those potential uses is converting the pit to a landfill. It is rumored that the landfill will accept many kinds of trash that cause harm to the environment, including major appliance, animal carcasses, containers with hazardous content warnings, leaking car batteries, and waste oil. Penelope then filed a lawsuit in federal court in New Jersey against the county alleging a violation of federal environmental laws pertaining to groundwater contamination and other pollution and seeking an injunction against the county. The court dismisses the case. Why?
