Legal Question in Business Law in New Jersey

Putting a lien on a house

I sold an item to a contractor who then installed it in his clients home.

The contractor is not paying can I put a lien on this house?

Re: Putting a lien on a house

Probably if it is done quickly. A lien is appropriate if the item was identified to the contract, delivered by you to the site for use there, or otherwise specifically intended for that contract. If you just sold the item to the contractor for his inventory without retaining a security interest in it, a construction lien might not be permitted.

Assuming that a lien is permitted under the circumstances, it must be filed within 90 days of the day on which the last materials were provided (exclusive of any warranty replacements). That's not a lot of time expecially since your lawyer probably needs time to prepare and file the papers.

My firm handles matters of this type. If I can be of further help to you, call or email.
