Legal Question in Business Law in New Jersey

How to retrieve paid equipment from vendor whom may never complete the work?

Over a year & 1/2 has passed since commissioning of several pieces of custom equipment from a vendor in NJ.

The vendor is paid in full for both pieces of equipment. One piece has been delivered in substandard, but semi-functional condiiton. Another may never be completed and we seek to remove our fully paid equipment from their premises.

The owner is unwilling to let go of the equipment without some legal maneuvering.

Need to know what our options are and how quickly we may be able to execute them. All reasonable attempts have been made. Our business has been hurt by this vendor, but a long and retracted battle will do more damage to us, then the vendor.

We want to complete the work in-house. Something after 1 & 1/2 years is better than nothing.

The total cost of the uncompleted equipment is in excess of $ 500,000.

I not sure I fully understand your post. Your options may depend on whether you have a security agreement or not. If you don't, you may have to initiate suit to recover. You should probably speak to an attorney as soon as possible due to the amount of money involved. Feel free to call me for a no cost initial consultation at 973-479-5814.
