Legal Question in Business Law in New Jersey
I signed a contract with a karate school to get my daughter lessons. She is 5. The contract is for one year of payments being automatically billed to my credit card. I'm unhappy with the karate school and I recently found out that the person who signed the contract on behalf of the karate school was 17 at the time. Is the contract legally binding to me to still pay for the rest of the year or is the contract invalid since the school's representative was a minor? I live in NJ and the karate school is in NJ.
1 Answer from Attorneys
Any attorney will say the contract is likely invalid if it was signed by a minor. Minors lack capacity to enter into a contract. However, a full review of the contact is needed so consult with a good business attorney in your area for specific advice.
