To sue for unpaid invoices is under the contract law or tort law?
The customer paid $4000, left 3,000 outstanding and refuses to pay citing ''no money''as excuse. I want sue the customer, but do not know it is under contract law or tort law.

This is a contract claim. Depending on whether your contract with the customer provided for it, you may be able to include attorney's fees and costs in your claim.
You may proceed in Small Claims court for claims up to $3,000. Between $3,000 and $15,000 you would proceed in Special Civil Part.
