Legal Question in Business Law in New Jersey

town zoning board running my business

I own a dance studio that is only ''allowed'' by the xoming board of the town to be open 4 hours during the week and 10 hours on a saturday- They tell me they have saftey concerns for the children crossing the street to the school- however, all other businesses are able to operate as they wish with no restrictions. Can I fight this?

I do this kind of law. I would need to know more about your situation, and look at the documents involved, to tell you what your options are. It sounds like you applied for a variance and these restrictions were placed on you.

Give me a call if you like. I would be happy to help you out.

Zoning Boards frequently overstep their bounds. Sometimes that can be used to advantage. To tell if there is an opportunity to do that here, I would have to have more information. Of particular interest is the source of the restriction and, if it is from a use variance, what the normal permitted use of the land would have been. Some investigation by one of us is in order. If I can help, let me know.
