Legal Question in Civil Rights Law in New Jersey

Bus Accident

I am a bus driver and got into a fender bender a few years ago while working for the Board of Education. Just the other day got served papers as driver of other vehicle suing Board of Ed and me for personal suffering and loss of work.

Do I need to seek separate legal representation or covered as was employed by Board of Education?

Based on the facts you provided, your employer will probably provide an attorney to defend you as it appears that the accident occured in the course of your employment. However, under certain circumstances the employer could claim you were acting outside of the scope of your job, which resulted in the accident, and therefore deny legal representation. At the very least, your interests and your employer's interests may not be the same. Therefore, you should probably consult with your own attorney to review the facts of the case and advise you concerning your personal liability, if any.

No you do not need your own attorney. As a former employee you are required to immediatly notify the your former emplo's legal department so that they can defend you in this law suit. If you delay contacting them (e.g. express mail) you may lose the benefit of their services. Best wishes.
